Terms of service
Article 1. Store Ownership and Scope
1.1. cardzgame.pro is owned and operated by ISun International Service Company Limited, a company incorporated in Hong Kong, trading as Cardz Game (the "Company", "we", "us" or "our"). The Company is the seller for purchases made through this store. References to Cardz Game in these Terms identify this retail business.
1.2. These Terms govern your use of cardzgame.pro and purchases made through its checkout. Our Shipping and Delivery Policy, Returns and Refunds Policy, and any product-specific terms disclosed before checkout form part of the agreement. Our Privacy Policy explains how we handle personal information.
1.3. These Terms apply solely to this retail store. A shared brand, product name or reference to another service does not create an account balance, redemption, storage, buyback or other entitlement unless expressly included in the product description. Any separately supplied digital or redemption product is governed by the actual entitlement and product-specific terms disclosed before checkout; these Terms do not reclassify that product as physical goods.
1.4. These Terms and the product description in effect when you place an order govern that order. Later changes do not retrospectively alter an accepted purchase. Product-specific terms take precedence only for the subject they expressly address and cannot remove rights protected by applicable consumer law.
Article 2. Eligibility and Customer Information
2.1. You must have the legal capacity to make the purchase and be authorised to use the payment method provided. A parent or legal guardian must place orders for customers who cannot legally contract in their own name.
2.2. You must provide accurate contact, payment and delivery information. Please notify us promptly of an error. We may request information reasonably necessary to verify an order, prevent fraud or complete customs clearance. We will handle that information under our Privacy Policy.
2.3. Keep your account credentials secure and notify us if you suspect unauthorised access. You remain responsible for purchases you authorise. These Terms do not make you automatically responsible for every unauthorised transaction involving your account.
Article 3. Products, Listings and Condition
3.1. The product title, written description, selected variant and identified photographs describe the goods being purchased. Review the card name, set or collector number, language, quantity and PSA grade before checkout. Contact us if those details conflict or are unclear.
3.2. Product photographs show the item offered unless expressly identified as reference or representative images. Where a listing identifies a specific PSA certification number, that certification forms part of the description. We will not substitute another card, grade, language or identified certification without your agreement.
3.3. A PSA grade is the assessment assigned by PSA to the card inside its holder. It is not a separate grade for the plastic holder or a guarantee of future resale value. Ordinary light holder wear disclosed in the listing does not, by itself, make the card incorrectly graded. Undisclosed material damage, a wrong item or a material mismatch remains eligible for review under our Returns and Refunds Policy.
3.4. Sealed products and physical mystery assortments, where offered, are supplied on the basis of their stated contents or selection description. A particular card, rarity or minimum value is promised only if the product description expressly says so. A random assortment must still meet its advertised description. Dissatisfaction with an accurately described selection or a subsequent market-price change is not a product defect.
3.5. Product names or artwork do not override the supply description. A physical product, a redemption instrument and digital access must be identified as such before checkout. These Terms do not convert one type of product into another.
3.6. Trading cards are collectible game items. We do not guarantee appreciation, resale proceeds, liquidity or a future purchase offer.
3.7. A manufacturer's or grading provider's subsequent opinion, policy change or reassessment does not by itself establish that the product was defective when supplied. We do not guarantee a successful regrade, crossover, authentication renewal or population-report entry. This does not excuse counterfeit goods, an incorrect stated grade or another material failure to match the agreed description.
Article 4. Prices and Payment
4.1. The checkout displays the product price, currency, delivery charges, applicable discounts and any taxes collected by us. Destination import charges not collected at checkout are addressed in our Shipping and Delivery Policy.
4.2. Payment must be authorised through a method offered at checkout. Payment processing is provided by third parties. Your bank or payment provider may apply its own currency-conversion or transaction charges; these are not charges set by us.
4.3. Discounts apply only under the conditions disclosed with the offer and cannot be combined unless expressly permitted. We may refuse orders, enforce disclosed purchase limits and revoke benefits obtained through duplicate-account abuse, automated circumvention, unauthorised payment or demonstrable fraud. A genuine complaint or lawful payment dispute is not, by itself, misuse.
4.4. We may suspend fulfilment of an affected order while reasonably investigating payment authenticity, a reversal or a material security concern. We will request proportionate evidence, review it without undue delay and notify you of the outcome. If the order cannot proceed, we will cancel and refund any amount we retain that is properly refundable. No customer is entitled to both retain goods and obtain a duplicate recovery for the same loss.
Article 5. Orders, Acceptance and Errors
5.1. Placing an order is an offer to buy the selected products. An automated order acknowledgement confirms receipt of the order. We accept an order when we expressly confirm acceptance or dispatch the goods. For a separately described digital or redemption product, acceptance occurs when we issue or activate the purchased entitlement, unless we confirm acceptance earlier.
5.2. Until acceptance, we may reject all or part of an order for stock availability, payment or security concerns, delivery restrictions, a material listing error, breach of a disclosed purchase limit or another legitimate operational reason. Items in a single checkout may be accepted separately as dispatched. We will notify you and release or refund payment collected for declined items and any corresponding unused delivery charge. Adding goods to a cart does not reserve stock.
5.3. If we identify a material price or description error before dispatch or supply, we will contact you. You may agree to the corrected offer or cancel the affected item for a refund. We will not charge a higher price, substitute an item or replace a cash refund with store credit without your agreement. Any correction after acceptance remains subject to your contractual and statutory rights.
5.4. We may correct an inaccurate operational message, but doing so does not remove rights already acquired under an accepted order. Please keep your order confirmation and correspondence.
5.5. We reserve any right available under law to correct or rescind a transaction affected by an obvious error that you knew or reasonably should have recognised. If goods are delivered by mistake or in excess of your order, notify us and take reasonable care of them while we arrange collection at our expense. This clause does not create a general right to reverse a valid completed sale or charge your payment method without authority.
5.6. A preorder or special-order listing must identify that status and disclose the estimated supply window before checkout. Supplier dates and allocations may change; a change does not give us an unrestricted right to retain payment indefinitely. If we cannot supply an item, we will notify you and refund that item and its related unused delivery charge. For a material delay, we will explain the revised estimate and any cancellation rights available under the agreed terms or applicable law. Accepting a revised estimate requires your agreement where it changes an agreed contractual deadline. No extra cancellation fee applies when cancellation is a remedy for our failure to supply.
Article 6. Cancellation and Order Changes
6.1. Orders are intended to be final once accepted. We do not grant a contractual change-of-mind cancellation right. You may request cancellation or an address change promptly, but acceptance of the request is at our discretion and must be confirmed by us in writing. Sending a request does not automatically stop processing. Statutory cancellation rights remain unaffected.
6.2. We may decline a discretionary cancellation once stock has been allocated, packing has begun, a special-order commitment has been made or digital supply has commenced. We may require renewed verification for an address change and decline an insecure redirection. After dispatch, carrier restrictions may prevent any change.
6.3. If we agree to a discretionary cancellation, we will state the refund and any proposed deduction before you accept that arrangement. Any deduction must be lawful, reasonable and limited to an evidenced, non-recoverable cost attributable to the request. We do not impose an undisclosed percentage penalty. Statutory refunds and cancellations caused by our inability to supply are not reduced by a discretionary-cancellation fee. Refunds are returned through the original payment method unless otherwise agreed or required.
Article 7. Shipping, Delivery and Ownership
7.1. Physical orders are fulfilled from Japan under our Shipping and Delivery Policy. Dispatch and transit estimates are stated separately. A label or tracking number being created is not proof of carrier handover.
7.2. We remain responsible for fulfilling the retail order. If a parcel is lost, damaged or materially delayed, contact us so we can investigate with the carrier and arrange the appropriate remedy. Your remedy is not automatically limited to the amount of a carrier's insurance payment.
7.3. Ownership passes when we have received full payment and the goods have been delivered. Risk of accidental loss or damage passes when you, or a person you nominate to receive them, takes physical possession. Any different rule required by applicable law takes priority.
7.4. You must provide a complete delivery address and cooperate with reasonable customs requirements. If a parcel is returned because of an address error, non-collection or unpaid import charges attributable to you, we will explain the available redelivery or cancellation options and any documented, legally recoverable costs. A returned parcel does not automatically forfeit the entire purchase price.
Article 8. Returns, Refunds and Authenticity Concerns
8.1. Our Returns and Refunds Policy explains how to report a wrong item, transit damage, a material listing mismatch or an authenticity concern. Please contact us promptly and preserve the packaging and item while we review the issue.
8.2. We do not offer discretionary change-of-mind returns for correctly supplied collectibles. A change in market price, or a preference about a characteristic accurately disclosed before purchase, does not create a discretionary return entitlement.
8.3. Where we supply the wrong item or an item that does not conform to the contract, we will provide the remedy required by applicable law. This may include replacement or refund. We bear reasonable return costs arising from our error or a confirmed defect.
8.4. Refunds are made to the original payment method unless another method is agreed or required. We do not impose store credit instead of a refund you are entitled to receive.
8.5. We may authenticate a claim against order records, identified certification numbers, dispatch evidence, photographs and the returned item. You must provide truthful information and reasonable cooperation. We may reject a claim to the extent evidence establishes substitution, tampering, damage caused after delivery or another cause for which we are not responsible. A missing unboxing video is not an automatic bar to a statutory remedy.
Article 9. Acceptable Use and Intellectual Property
9.1. You must not use the store for unlawful transactions, payment fraud, unauthorised access, malicious software, deliberate interference with the service or deceptive claims. We may restrict access where reasonably necessary to protect customers and the store. Restricting access does not cancel valid refund or delivery obligations.
9.2. Store content is owned by or licensed to its respective rights holders. You may use it to browse and purchase products, but may not reproduce it commercially without permission. Third-party card brands, artwork and PSA marks belong to their respective owners. Their use to identify products does not imply endorsement or affiliation.
9.3. We may take reasonable steps to prevent automated purchasing, scraping that interferes with the store, promotion abuse or unauthorised commercial use of our content. Where you deliberately commit fraud, submit fabricated claim evidence or knowingly infringe our rights, we may seek recovery of directly resulting, proven loss and reasonable enforcement costs to the extent legally recoverable. This is not a penalty for making a good-faith complaint or exercising a lawful payment-dispute right.
Article 10. Responsibility and Service Interruptions
10.1. We are responsible for losses that are a foreseeable result of our breach of contract or failure to exercise reasonable care. We do not promise uninterrupted website access or any particular future market value for a collectible.
10.2. To the extent permitted by law, we are not liable for business losses such as lost resale profits, lost business opportunities or loss of goodwill arising from a consumer retail purchase. This clause does not restrict remedies for non-delivery, defective goods or goods that do not match their description.
10.3. If events outside our reasonable control delay performance, we will notify affected customers and take reasonable steps to reduce the impact. Such events do not automatically extinguish our obligation to supply the goods or provide a refund where required.
10.4. Nothing in these Terms excludes or restricts liability for fraud, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or restricted.
10.5. Subject to Article 10.4 and any applicable reasonableness requirement, our aggregate liability arising from an affected order is limited to the amount paid for the affected products and the related delivery charge. This cap does not reduce an entitlement to a statutory refund, replacement, repair, reasonable return costs or other non-excludable remedy. We do not exclude liability for the basic obligation to supply goods of the agreed description, quality and title. Liability that cannot lawfully or reasonably be limited remains unaffected.
10.6. Subject to Article 10.4, we are not responsible for loss caused by your failure to follow reasonable care or delivery instructions, unauthorised alteration of an item, inaccurate information you supply, or an independent third party you appoint, to the extent that cause is not attributable to us. You must take reasonable steps to avoid or reduce recoverable loss. No exclusion applies merely because a carrier or other service provider performs an obligation on our behalf.
Article 11. Complaints, Governing Law and General Terms
11.1. Please contact us with your order number and the outcome you are seeking. We will review the relevant order, listing, payment and delivery records. Contacting us does not prevent you from exercising lawful rights through your payment provider, a consumer authority or a court.
11.2. These Terms are governed by Hong Kong law. Subject to any mandatory consumer jurisdiction rights, the courts of Hong Kong have exclusive jurisdiction over disputes arising from these Terms or a store purchase. Mandatory consumer protections available where you live remain unaffected.
11.3. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive it. We may transfer the business or this agreement only in a manner that preserves your rights under an existing order.
11.4. These Terms are issued in English. Translations may be provided for convenience; mandatory local-language requirements remain unaffected.
11.5. These Terms, the applicable policies, the product-specific disclosures and the accepted order form the agreement for the purchase. General advertising does not promise benefits beyond what is expressly included, but nothing here excludes liability for a legally actionable misrepresentation. Our records may be used as evidence; they are not declared conclusive against contrary reliable evidence. A discretionary accommodation in one case does not oblige us to make it in another.
11.6. No person other than the customer and the Company may enforce these Terms under the Contracts (Rights of Third Parties) Ordinance, subject to any right that cannot lawfully be excluded. We may revise the terms for future purchases, preserving the terms applicable to existing orders. Provisions intended to survive completion or termination, including payment, intellectual property and dispute provisions, continue to apply to the extent relevant.
